Last week, I published a piece on C.F. v. Capistrano School District. In that case, a federal judge ruled that when schoolteacher James Corbett referred to another teachers assignment asking students to provide scientific support for c reationism as superstitious nonsense, he violated student Chad Farnans First Amendment rights.
Mr. Corbett has graciously agreed to appear as a guest blogger, and provided us with his editorial on the case, published below.

Over 2,000 years ago Socrates faced a court for refusing to recognize the gods acknowledged by the state, importing strange divinities and corrupting the young. The judges sent Socrates to his death. He accepted the sentence of the court and committed suicide by drinking a cup of hemlock.
The only virtue for Socrates was He reached it by questioning the most deeply held beliefs of his students by which I mean all of Athens and ultimately all of us. What troubled the Athenians about Socrates, however, was not listed in the charges. His crime was that he prompted people to think.
His provocations exposed the Athenians shallowness of belief and mindless deference to myth. Socrates was judged because he was successful in provoking his students examine their lives. [his words]Those who guard the myths must try and strike down any who teach young people to think and question, because myths often shrink in the light of reason, draining power from those in authority who benefit from belief.
There are thousands of teachers who agree with Socrates that, [t]he unexamined life is not worth living. Every teacher who makes a student think takes the risk that he will be attacked by parents and others who see themselves as guardians of cherished political and religious myth. The teachers willing to take that risk should be rewarded, not punished. After the verdict, the Athenian court asked Socrates what his punishment should be. He responded that he should get free meals at the Pyrataneum, a celebration hall for Olympian athletes. Socrates went on to explain that those who passed judgment were not harming him, but rather themselves. He said, by killing him they corrupted their own souls and revealed the weakness of their own belief. A true believer does not fear that a few questions can undo years of parental teaching. Those who would students from self-examination have little faith and great fear.
Chad Farnan, the boy who sued me, was an average student, who admitted under oath that he did not do the required reading for the class. If Chads lawyers, the Advocates for Faith and Freedom, and his parents were actually concerned with protecting the boy, why didnt they simply come to me and ask me to explain my comments? Neither they nor the Farmans ever expressed concerns to me nor to any administrators before they came to school with attorneys and reporters in tow to drop a lawsuit on the desk of Tom Ressler, our principal. Perhaps more importantly, the Farmans were aware long before Chad took my class that I go out of my way to be provocative. Every year in July, I send a letter home to students who have signed up for my class. Chad admitted under oath that he received that letter. The letter says, in part:
Most days we will spend a few minutes (sometimes more) at the beginning of class discussing current events from either The Orange County Register or the L.A. Times. I may also use material from a variety of news Web sites. Discussion will be quite provocative, and focus on the of history. My goal is to have you go home with something that will provoke discussion with your parents. Students may offer any perspective without concern that anything they say will impact either my attitude toward them or their grades. I encourage a full range of views.
I included my home phone number and e-mail address in that letter and encouraged parents to contact me if they had any concerns. Chad admitted under oath that my lectures prompted many discussions with his parents. I might add, that in 20 years in the CUSD, I have never had a complaint filed against me, save this one.
Every teacher in California (this was a federal case after all) now works with the knowledge that any student, at any time, and in violation of California law, can sneak a tape recorder into a classroom, record the teacher and use an out-of-context five second comment as a bludgeon to threaten, to intimidate and, ultimately, to destroy the teachers career and good name.
Challenging myths is dangerous, but it is the essence of getting students to think for themselves. The Athenian judges, like some parents today, would have students accept myth without question, because myth is the foundation of their parental, political and/or religious authority. Ms. Farnan objected to my challenging the myth of the Puritans as a pious people who fled religious intolerance to found America. As Ms. Farnan sees them, the Puritans are quaint, pious people with buckles on their hats and shoes as portrayed in the national mythology, but they may also be seen as intolerant, misogynistic and homophobic religious bigots who hanged Mary Dyer, a Quaker girl, for preaching something other than Puritan doctrine and several other women for the crime of
Questioning may make students and parents uncomfortable, but students have a right to think for themselves. It is not to demand that students think.
Ms. Farnan also objected to my challenge of another national myth, that the United States was founded as a nation. There is some truth to that notion, but embracing that myth and excluding other views can be used to unfairly gain political advantage. Another view of the founding fathers can be seen in the writings of Thomas Jefferson, the man who authored the Declaration of Independence. He translated the Bible. The last words of the Jeffersonian Bible might shake Ms. Farnans faith: There laid they Jesus, and rolled a great stone to the door of the sepulcher, and departed. There was no resurrection for Jefferson, he rejected all the Biblical miracles, as contrary to reason. I doubt with his view would be called by Ms. Farnan or anyone else. James Madison, who penned the Constitution, warned, Religious bondage shackles and debilitates the mind and units it for every noble enterprise, every expanded prospect. If Jefferson and Madison were alive today, I doubt they could be elected. The guardians of the national myth would rise up and smite them as unbelievers.
We respect the guardians and their myths at our peril because history (and science) changes and improves with knowledge, but the same force damages myth based on belief. Thats why the guardians fear the knowledge begat by questioning. For them, is gained in rote memory of approved truth. They chant in the school, temple, church or mosque and fool themselves into thinking theyve acquired knowledge.
All those teachers, and there are many of us, who understand the value of questioning sacred myths serve this nation as faithfully as other patriots. What is true will be strengthened. What is false will be destroyed, as it should be. Such teachers should be honored. There is no greater gift teachers can give to students than to teach them to think. Dont sue them for it. Try taking them to the Pyrataneum for dinner, conversation and a cup of coffee, no hemlock.

Judge McLaughlin granted the motion to dismiss based on the plaintiffs failure to adequately plead scienter. She found that the plaintiffs allegations do not establish either motive and opportunity or conscious misbehavior or recklessness on the part of the defendants and that the plaintiffs therefore have not raised a strong inference of scienter. She also found that the inference of scienter the plaintiffs sought to draw is neither cogent not at least as compelling as the plausible opposing inferences suggested by the defendants.
The plaintiffs had alleged that the defendants had delayed announcing the material impairment to the C-Bass investment in order to allow the completion of the MGIC merger, and also to allow the defendants to sell shares in their personal holdings of Radian.
Judge McLaughlin found the motivation to complete the merger is not distinctively unique as it is like the motives that have been found to be generally possessed by most corporate directors. She also found that the plaintiffs failed to allege any concrete and personal benefit the completion of the merger might provide the individual defendants.
Judge McLaughlin found further that the allegations of insider trading inadequate to establish motive and opportunity. One of the three individual defendants more than tripled his investment during the class period, which a second sold only 2.7% of his holdings, and the related Form 4s showed they were sales of restricted stock, and in part motivated to pay taxes. The third individual defendant sold a much larger percentage of his holdings but the public record showed that he was not planned to be a part of the merged company and was divesting his ownership.
In support of their allegation that the defendants had been reckless, the plaintiffs had argued that as a result of their positions with Radian, the defendants were aware of the risky nature of C-Basss business and the deteriorating conditions of the subprime industry. Judge McLaughlin found first that the plaintiffs allegations did not establish that C-Bass was in fact impaired before the company took the impairment charge. Judge McLaughlin also found that the plaintiffs allegations did not establish with sufficient particularity that the defendants knew or should have known that their statements presented an obvious danger of misleading the investing public.
The plaintiffs had also argued that the defendants had to be aware of the problems at C-Bass because of their positions of responsibility within the company and the relation of the C-Bass investment to the core operations of the company. Judge McLaughlin said that while some courts have found that knowledge of core activities can be imputed to company officials under some circumstances, they had done so only when there were particularized allegations showing that the defendants had ample reason to know of the falsity of the allegedly misleading statements.
Judge McLaughlin said that the plaintiffs had failed to explain why C-Basss activities were part of Radians core activities. She also found that the plaintiffs had failed to show why defendants must have known that their statements presented a danger of misleading investors. In this connection, Judge McLaughlin reviewed the plaintiffs extensive allegations about the deteriorating conditions in the subprime marketplace, which the plaintiffs alleged the defendants must have known.
With respect to these allegations, Judge McLaughlin observed that these facts were known to the plaintiffs and by the market at large, and the [amended complaint] itself establishes that Radian publicly disclosed its knowledge of these facts and their potential to effect on Radians investment in C-Bass.
Judge McLaughlin also found that the plaintiffs attempt to establish scienter in reliance on confidential witnesses, the defendants sox certifications and the companys alleged violation of GAAP were equally unavailing,
Judge McLaughlins opinion joins the growing list of subprime and credit crisis-related securities class action lawsuits in which courts have granted preliminary motions to dismiss. It is also is yet another case that seems to reflect a general judicial unwillingness to conclude that merely because companies were caught in the downdraft accompanying the subprime meltdown that the company had engaged in fraud.

The following rant comes with the obligatory disclosure that I only complain about The Office because I love it, and that a weak Office episode is still better than most of television, and this season as a whole has been a huge step up from the rut they were in last season, etc, etc.
That being said - Why was every single character on last nights Willy Wonka episode acting like a complete idiot? Not in the sense that the characters are always dumb and goofy in an amusing way, but as in none of these human beings would ever act this way and this is really frustrating to watch?
The episode opens with Michael acting like Willy Wonka. Fine. Michael slips 10% Off Golden Tickets into five random shipments of paper, but they turn out to all be part of one large shipment to one large client. Pretty funny, off to a good start.
But when Blue Cross calls the office to inform Michael that they received all five golden tickets, Jims first reaction is Did you put limit one per customer on the tickets? Im going to call corporate to make sure they know I didnt lose fifty percent of my sales. Oscar also confirms re our biggest client and later laments they can fire all of us!
Why wouldnt EVERYONES first reaction be, s call Blue Cross, explain the mistake, give them 10% out of courtesy, and move on with our lives? How unreasonable are the clients that theyd actually even think no no no, you said 10% per ticket so we get half our sales for free!!! Even though regular 10% coupons never work like that, let alone these made-up golden ones! Neither Jim nor Pam thinks of this, they just immediately turn retarded and panic, because it wouldve solved the episodes dilemma before the second commercial.

Kendra Wilkinson spoke to People about her wedding plans. Specifically, her bridesmaid dresses and the Palm Springs bachelorette getaway thats planned.

For those using WordPress and bbPress forums, the hassle of merging the two is frustrating and tedious. They want bbPress to recognize that WordPress is installed and automatically configure the two to work together seamlessly.
Those dependent upon bbPress for their forums long for a few feature improvements, more bbPress Plugins, and improvements in bbPress documentation.
With recent announcements from the bbPress blog and forums, it looks like all parties will begin to see some light at the end of the tunnel.

My life has never been a soap opera. It's been relatively uneventful. Before I went to college, the worst thing that ever happened to me is I didn't get my learner's permit on my first try. For a girl who lives outside of southern california and newEngland, I'm pretty spoiled. My family is an upper-middle class family in the heart of central Virginia. It's not exactly the most exciting place to live. In fact, it's downright dull. I wanted to make up a more interesting life for myself to people who would like me for it. I don't lie to people. Honesty is the most important thing to me. Trust is earned and valued. I had a good life with good friends but Iwanted some controversy in my life. I wanted my life to be more interesting. I know it's cliche, but be careful what you wish for. I don't regret the past three and a half years. I would do it all over again. They were the best of my life.
It all started in 2002 when I still had AOLand was allowed only 1 hour of internet a day. I would use it to go into the music chatroom on AOL and pretend to be someone else. Someone I totally made up, but whose life was far more interesting than mine. I didn't get too attached to it and found other things to do by the time I was a senior and we got rid of AOL and got comcast later that year. Ihad unlimited access to the internet but Iplayed neopets every chance II forgot about chatrooms and instant messenger until I went off to college in fall 2003. Freshmen couldn't have cars and I was a social recluse so there wasn't much for me to do but stay in my room. The internet was down for nearly a month because of a virus a freshman brought in with their new computer that ate its way through the routers. Once internet access was restored, however, I downloaded AIM and created a new persona for new people to love.
I called myself Blake, born on March 10, 1986, an 17 year old only child from Maryland who moved to Sacramento California just a couple years ago and loved Good Charlotte and Blink 182. I claimed I was so smart that Iskipped 9th grade. I made up some pretty outrageous things during the first few days to make myself appear worth knowing, because who would ever want to know Robin, an 18 year old college Freshman from Richmond, Virginia who never even left the country, let alone the East Coast. I was a boring person. Boring and ordinary. The first few days I used AIM and its chatrooms, Icouldn't tell the difference between music0 and music1, until a guy named Joe from Michigan told me to come into music0. I was already making friends. People liked me. I liked that. I should've stopped after a few days, but I got so attached that I would stay up all night and miss class so I could make up the sleep that I missed talking to Carrie, Michelle, and Joe the night before.
At first I was worried that Iwould be found out. That someone would track my IP or ask for pictures that I didn't have, or want to talk to me on the phone. It would've been easier that way; I could've just stopped getting online. I could've made a new screen name and I could've been honest. The drama that unfolded over the next few months certainly wouldn't have happened if Iweren't such an attention whore.
I developed a particularly close bond with a girl named Carrie, from New Jersey and one day she confessed to liking me a lot. So much so that it strained our friendship and caused her to lie to me that she was over it. It made talking a little easier but I tried to blow it out of proportion and milk the drama for all it was worth. I complained to as many people as I could about how appalled and hurt I was that she didn't think I deserved to know the truth, and that she couldn't be straight with her feelings about me. It made me sound a lot more trustworthy if I got that upset over someone else's lies.Iadded a twist to the whole situation by claiming to be in love with a girl named Jen, whom I called Smithifer. It was our own little e-triangle. It was some drama, but it wasn't enough. I told a select few people that I was experiencing kidney failure as a direct result of my diabletes I've had all my life.If I didn't get a kidney transplant, I had only 6 months to live. I figured I'd be over the chatroom and my new friends by then.
In my real life, I was experiencing college and living away from home for the first time. I have a desperate desire to please people and I have the hardest time saying no, so I joined a couple BIble groups that were just a waste of time to me. Ifinally couldn't take it anymore and resign myself to complete and total honesty, except on the intet because it's only the internet. It turned out to be my whole life for way too long.
Concerning my situation with Carrie and her unresolved feelings for me, Ibegan to confide in another Jen whom Icalled Jennifer for clarification. Joe began to confide in me about a girl named Ashley who was playing mind games with him and another guy named Shane. She ultimately chose Shane and Joe was crushed but she didn't stop there. She tried to steal Chris away from Lainey while she was still with Shane. And eventually, stole the first and so far only guy I've ever loved. I've never loved anyone more.
His name is Eric and we did not get along at all at first. We clashed over Ashley from the beginning.Even before he cheated with her on me. Carrie and I said what a horrible, heartless, selfish person she is, but he wouldn't listen. Ashley and my relationship was never officially defined as anything. We were nice to each other most of the time, in passing. But we never talked intimately after she thought I betrayed her by talking smack about her behind her back. Maybe that's why she stole my Eric away. But it wasn't until April 2004, only a few weeks after Eric and I decided to date because Ihad recently come out as being gay. Another twist in my internet fantasy life that would haunt me to this day.
Eric thought I was stupid and hyper and a clown. He didn't respect me because he didn't think I respected Ashley, who was still with Shane while she and Eric were gradually getting closer. But one day I said something intelligent and his whole perception of me changed. Since then we were inseparable. We did everything together in the chatroom. We had the same fonts and said the same things and liked the same music and had the same sense of humor. We even liked to annoy the same people. He defended me countless times to numerous people and lost a lot of friends because of it. But he was a pothead and that really bothered me. Max and Lainey invited me to the powerpuff girls chat where I met a whole new group of people with no sex bots. It was full of mostly arrogant scene kids under legal driving age but I met a kid named Josh who was really nice and fun and actually talked to me all night. Augie would show up from time to time as well. But once I left music0, I lost contact with Michelle, Shane, Carrie, and a lot of others. some had already left, like Joe, Melissa, Jennifer, Dan, and Nicole. n00bs were taking over and it wasn't the same. But neither was PPG. I still came into music0 for a while, until Eric had enough of the lies and secrets. I couldn't tell him the truth so Imade up another vague lie but it didn't suffice this time. Instead of telling him the truth, I decided to end our friendship. By the end of the summer in 2006, word had gotten around that I was the biggest fake in the history of the internet. I decided that the best thing for me was to get back to the real world so I contacted several of my old high school friends and got together with them. I went to see Fall Out Boy with one of my friends whom I've known since elementary school. I even made some new friends and got a new boyfriend. One that I could talk to, not just in an IM window. I think of everyone less each day than I did the day before. Sometimes days, even weeks go by when I don't think of them at all, until a thought of them blindsides me on some idle afternoon or in the middle of the night. But lately I've been thinking about them a lot, even Ashley. I don't think I'll ever completely stop thinking about them, and I know I'll never forget them. But it's a lot easier to deal with the loss when I have a real life to fall back on.
With the help of Max, a hacker from Florida, I stole all her internet aliases from every imaginable program/site. I even found more of her online journals and took them over, too. I told Eric and he thought it was so funny and wanted to join in. I was so relieved because I thought he would be upset that I was still obsessing over Ashley. To this day, I still check her myspace to see if it's still private. I still look at Eric's facebook and myspace. I still see if Michelle has updated her livejournal. She's married now. I've saved chats, IMs, pictures, and drawings from everyone and they're on a CDin my room. I save the pictures I find onEric's facebook. I wonder if they still think about me or if I'm the only one who reminisces about music0. We had a lot of fun. Someone I totally made up, but whose life was far more interesting than mine. I didn't get too attached to it and found other things to do by the time I was a senior and we got rid of AOL and got comcast later that year. Ihad unlimited access to the internet but Iplayed neopets every chance II forgot about chatrooms and instant messenger until I went off to college in fall 2003. Freshmen couldn't have cars and I was a social recluse so there wasn't much for me to do but stay in my room. The internet was down for nearly a month because of a virus a freshman brought in with their new computer that ate its way through the routers. Once internet access was restored, however, I downloaded AIM and created a new persona for new people to love.
I called myself Blake, born on March 10, 1986, an 17 year old only child from Maryland who moved to Sacramento California just a couple years ago and loved Good Charlotte and Blink 182.
