Ahmm... The Supreme Court is not supposed to "break free" from the constraints of the U.S. Constitution; it is supposed to uphold, protect, and defend the Constitution of the United States. It is only supposed to determine if a law passed by Congress is constitutional or not. The Supreme Court is not supposed to "make" law. God knows we have enough people trying to do that. In the 1990s, there were 5,000 bills before the Congress.

Give 'em more vacations, I say. What happened to our citizen-statesmen who were supposed to support themselves with work at HOME?

I would also point out that since LBJ's Great Society, we have had plenty of "redistribution of wealth" that has led to a separation among our people and has led to part of our social structure being made up of folks who have become dependent upon "government" by legislative design, it seems to me, and another part of our society that is forced through confiscatory taxes on income to support those whom the government has made dependent or "enslaved."

We fought a Civil War for a number of reasons and lost over 500,000 men in the process. We ended slavery in the South, not in the North at that time; however, it seems to me that a faction of our political elite won't let slavery go and have just substituted the plantation for government entitlements of many varieties to keep some folks down, mainly the poor - all of our poor - to vote the very folks who enslave them back into office. The rest of us are "enslaved" through confiscatory taxes.

It's like the communism of a condo community. You can control your mortgage but you cannot control the condo fee. It is an open ticket to the poor house and likely can equal or surpass your mortgage payment over time.

The poor cannot rise out of poverty because government simply will not allow it... Certainly, to me, Democrats enslave the poor by mesmerizing them with the promise of a better life through government subsidies designed to keep them at a subsistence level and designed to "buy" their vote.

To former Illinois State Senator Obama, we've had plenty of "wealth redistribution" and "wealth distribution" is NOT the job of a Supreme Court sworn to uphold the US Constitution. Actually, the Founding Fathers did not give the right to vote to anyone who did not have a vested interest - land, property, income - in the how their taxes would be spent. They certainly would not have supported one part of the citizenry legally "stealing" from the producing class.

Now soon-to-be President Obama will face a challenge: to clamp down on the American people who are the creators of jobs and of innovation or to reduce taxes, reduce capital gains taxes, and open the flood-gates of American ingenuity to "set our people FREE."

Americans can solve our problems - the less government intrusion, the better.

ll only break your heart, its a fact. And even though I warn you, even though I guarantee you that the boy will only hurt you terribly, youll still pursue him...aint love grand?s one of my favourite quotes from Great Expectations (the adapted modernized movie)... me and my double entendres, you should know where Im going with this... aha! But thats where youre wrong.
Im not going to talk about love tonight, nor am I going to talk about the fallacies of having great expectations when one is in love, because lets face it... expecting ANYTHING remotely associated withlove these days from anything that is not a four-legged puppy is just plain wrong. And deceptive. Also, I know *nothing* about love, so who am I to write a discourse on it anyways.
So instead, I am going to talk about the next best thing that I feel I have adequate knowledge of - waiting.
I know a lot about waiting because well... youre going to have to take a big breather here because it will come as a shock to you.... I know a lot about waiting because unlike my blog persona, Im a very patient person in real life.
Sometimes when I go out with my friends, or going out with my parents or family, and they happen to be late, I wont really care. Ill wait for them to get ready, wax, pick out their clothes, put on their nailpolish, dry their hair, feed their puppies, peel a mango, entertain their kids, go into labour - whatever. I may not necessarily like it, mind you.. but I will wait. I will wait because...1. Ill probably blow up at them if I had to confront them which will not be pretty and 2. I hate confrontations
SO. What is my point? Waiting should be incorporated into our natural daily existence, so it doesnt peeve us off. If people in South Asian/Mediterranean cultures and countries can incorporate it into their daily lives, especially when they are going to work, or going to a family dinner, you too can do it. Its not so bad once you get the hang of it.
What they dont do, these aforementioned cultures mentioned, is wait lifetime for a soulmate.
Aha! This is a concept that is fairly new to them. As soon as they notice remnants of facial hair or boobage in a person coming of age, said person is in trouble. That is when the waiting game is thrown in the dumpster in favour of an accelaration lever.
On the other hand, in European/North American world, we are encouraged to wait. Wait perfectly in line in that queue for the cashier to pay for the groceries... wait for your turn, patiently.
Relevance?
We spend our lifetime waiting. Think waiting in lines at the bank, waiting for that raise. Waiting to be 2 sizes smaller and 10 lbs lighter. Waiting for our kids and parents to understand us. Waiting for that savings account to grow. Waiting to be old enough, to be responsible, to be accepted by society. Waiting for that call. Were always waiting. We are such patient creatures. Waiting for someone to notice us, waiting for someone to make the first move, waiting to say something cute, waiting for that jerk youre dating to come to their senses, waiting to be liked, waiting to be recognized, waiting waiting waiting... continuously. Constantly waiting for that one person.
And they have no idea that youve been waiting for them. And sometimes they dont even care even if they know.
We busy ourselves with projects, activities, hobbies - we may deny it and say that were not waiting, that if the other person comes along its because they were meant to come along and we werent really waiting.. but the fact remains, my pretties, is that AFTER that person has come along, do you just look past that person? No, you dont. You give that person a chance. You wouldnt have given that person a chance - that net value of waiting - if you werent waiting for him/her. If you truly were not waiting, you would overlook immediately.
Sorry, this is one of those boring thinking posts.
My question: Why the frig do we wait? Why is there a selective filter for waiting? More importantly, why is it that we are totally messed up in our priorities when it comes to waiting for different things? Some of us wait because we think we know what we want... that thing... so we wait for that thing to come along. In waiting for that thing to come along, we have built up expectations. Expectations that cause us to justify more of said waiting. Expectations that are not necessarily realistic. Maybe even more stupid expectations. Eventually, we replace the word to not wanting to settle. So we wait. We wait for the other person to make the move. Sometimes we wait for a sign from the heavens. Sometimes we wait for destiny. Sometimes we wait because we are filled with hope for the possibilities that lie ahead of us. Sometimes we wait because we have no choice.
Waiting is such a load of shit. What bollocks.
Misery loves company, especially if its a company or a truckload of people playing the waiting game. If theres one thing Ive learnt being an emo girl, is that an emotional nutjob like me IS the end result of endless waiting games. I dont know how I picked up this trait - my parents are anything but patient. My dad never waited for fortune or luck to land on his lap - he worked his ass off for it. My mom didnt even wait with us kids - she had 4 of us back-to-back.
And here I am/was, me... Ms Wannabe champion of the world, waiting... waiting.. waiting.. for her time in the sun.. knowing full well, the sun has been there since millenia, and has been doing its part.
Waiting to make an impact, to be part of someones world... when I wasnt even in their dreams to begin with.
Waiting for my own great expectations that would lead me to that moment of clarity of love being all grand like a quote from a novel...
Wow. What a waste of time. Waiting. What a waste of a word. So many Ws in one sentence...meaning the one same shitty thing.
There are some things in life worth waiting for - the birth of a child, waiting to see the sun rise at the top of a mountain, waiting to see your kids grow up, waiting for the goddamned emergency doctors to see you after making you wait for 12 hours, waiting for that call centre dude from India to remove you from the (hahahhaha). But there are other things in life that are just not worth waiting for - waiting for that call, waiting for someone to come to their senses, waiting for someone to miss you.
I said I wasnt going to talk about love, and Im not talking about love here. If someone is making you wait, for all the wrong things and for all the wrong reasons, if theyre going to make you wait, giving you hopes - your great expectations, if you will - only to take it away later, itnot love.
So get out, get out, get out of that waiting game. Its painful, ituncalled for, its useless and its a waste of time, space, money, emotions, life. Stop waiting.Go create your own game, and youwill create your own great expectations.

As with any transfer to a new system stuff gets lost. In our case we hadn't backed up in a while so much of what we need was not of the latest version. But fear not we are getting there.

Our biggest let down was Windows Vista e-mail program (It's no longer called Outlook Express.) would not import our old email. That's not as bad as it sounds. With Gmail we still have access to most our e-mail. Anything older than when we started our Goggle mail is probably lost.

Also the new version of the Windows address book sucks. I just don't know how they can go from something that was usefull to a piece of crap.

I may yet dump Vista and return to XP. We will give it a few monthsbefore we make that decision.

Dell claims they shipped the laptop on Monday, December 1. It arrived today, Tuesday, December 2. That's barely over the 24 hours mark. And it was shipped from Tenn. by FedEx. Is that great or what? This was a 3 to 5 day delivery. I'm impressed with Fedex. Really.

Waking up with the waves on Thanksgiving.  Well its looking kinda fun, but you can be sure its going to be pretty crowded at many spots due to the holiday.
Its mostly clean, but some spots are seeing some texture or light bump on it.  Weve got mostly a minor dose of south southwest swell in the water.  That recipe is making for some crumbly sectiony lines with a few fun corners.
Most OC beaches are running about knee to waist high with the top south facing spots pulling stomach to chest high waves with an occasional shoulder high set.
At 7:58 a.m the tide climbs up to a 6.2 high which will have some spots pretty full and slow mid morning.  The tide then drains out to a negative 0.5 low at 3:21 this afternoon.
If youre gonna grab a session before you start your turkey feast, break out a 3/2 fullsuit with the water temp at most breaks hanging between 59 and 61degrees.

Beach Baby Blog to China: Meet Jazmyne

  • Nov. 30th, 2008 at 10:22 AM

Now fast forward about 6 months. I am part of an Internet group for parents who have adopted from Chloe's orphanage. It's a great way to learn more about the orphanage and understand our girls better. There was a family who have adopted from there and live in Beijing. They were planning a trip with their girls back to the orphanage. I emailed them to see if they could take the picture along of Chloe's Jie Jie along to get some more information. When they showed the photo to the nannies, they said that both girls were quite attached to each other. Her name is Qian Jiang Can and she had just been adopted to the United States in Sept. When I saw the name of the little girl, I could hardly believe it. I have been corresponding by email with a family from Michigan who adopted a 2 year old from Chloe's orphanage. We have emailed back and forth answering questions, etc. for months and I even spend an hour talking to them on Skype (Internet phone) the week before they left for Chongqing. Chloe's Jie Jie that she has grieved for is their daughter! Not only was this little girl that was so special to Chloe no longer at the orphanage, she had been adopted to a family that we knew. They only live 6 hours from us. Her name is Jazmyne. Her mom showed Jazmyne Chloe's pictures on our blog and she called her by her Chinese name and said Mei Mei (little sister). God has seen fit and cared enough to place these two little girls who have shared so much in homes just a few hours apart. We will be getting these two "sisters" together on Thanksgiving weekend.

We haven't had much going on in the Namie household. Just cleaning house and I have been fighting the urge to put up the tree....Bobby begged me not too and asked if I could wait til Thanksgiving, so I am trying my hardest....I have been killing him with the Christmas music though! We have direct TV and there is a section of XM radio and they have a channel that plays nothing but Christmas....it is great! I have started making Peyt's Christmas stocking. I had to take it to my mom's yesterday b/c I was confused. So many things to cut and sew. I think I have it now, we will see :) MiMi got to spend some time with Peyt, which she loved. We are gearing up for Thanksgiving. I can't wait....Thanksgiving is my favorite holiday.

Other than that, life has been somewhat normal. I have been trying to lose the rest of this baby weight and it has been really hard. I have 7 lbs left, so I am hoping the holidays don't blow it! I am just excited to finally "fit" into some of my clothes...I can't breathe, but I can get them on, so that is a huge accomplishment!

As you can see below, Peyt absolutely loves her feet! She can not get them out of her mouth. When I feed her, she is sucking her toes....it is too funny. We are introducing foods to her now....she loves peaches and thinks bananas are okay. I am going to give her green beans for lunch today, so we will see how that goes. She is laughing all the time now and will hug you when she is picked up. She is still teething....so much drool and she will not take a teething ring, but she will chew on my chin and sometimes a pacifier for a few minutes. I can't believe she is almost 6 months old. Time sure does fly, but I have to say that these have been the best 6 months of my life. She is just a joy and life continues to get better every day.

I will try to get another post up soon. Hope everyone is doing well....and have a great week.

Eddie Ross, and I recently discovered he has a blog! And wow, is it a great blog. You are going to love it too, so I had to share it with all of you. Eddie has such great style and creativity and shares it all on his blog. And his blog is so down to earth, with beautiful real pics of his own home that show all his projects up close and personal. You will want to try them all! And his motto is, "it doesn't have to be expensive to be beautiful." I couldn't have said it better myself!

At only 30 years old, Eddie is a culinary school graduate and lives in New York, where he works as Senior Style Editor for Martha Stewart Living (yes, THE Martha!). His talents range from decorating and entertaining to food styling and flowers and his blog is chock full of great informative posts to soak up. What I really love about Eddie is his passion for shopping flea markets and thriftstores, from Goodwill to Salvation Army. He takes his readers with him and shows them all the valuable treasures that he uncovers on those thriftstore shelves and flea market jaunts and even gives ideas right on the spot of what he would do with said items. Now, that is something I can relate to, as you all know! He regularly visits the Hell's Kitchen flea market in NYC and finds all sorts of cool things. He's only been blogging since summer and already it's a teriffic blog. I predict we'll be seeing a lot more of Eddie.

A DeLand man found out the hard way he couldn't get away with spending counterfeit money twice at the same location.
Steven L. Murphy, 19, now faces three charges of passing counterfeit money and he's going to need $3,000 in real money to get out of the Volusia County Branch Jail.
The first reports of funny money being passed were received Wednesday by DeLand Police. A clerk at Discount Food and Beer, 800 S. Woodland Blvd., told officers a man used a $20 bill to buy a 20-ounce soft drink and he had already left when it was discovered the money was counterfeit.
Later that day, the same man tried to spend a $50 bill at the store, but was refused. He was gone by the time police arrived.
On Thursday, the El Manatial Mexican Restaurant at 827 S. Woodland Blvd. gave a man about $47 in charge when he purchased two tacos with a $50 bill that turned out to be fake, police said. The restaurant did not report that incident, but called police later Wednesday when the man returned to buy one taco. He was waiting for his food when police arrived and arrested him.
According to a police report, Murphy told officers he knew the money was counterfeit and that he traded a video game for it. He also told officers he used the change he received to buy diapers and sippy cups for his baby. He said he went back to the restaurant because he needed to buy more items for the child.

Pensacola Beach Blog: Youre Acquirement Mail

  • Nov. 21st, 2008 at 10:48 PM

While a select few fans of continuing our addiction to Middle Eastern oil always manage to get sycophantic Pensacola think tanks like the Haas Center and the Whitman Center to include "more parking" in their long lists of recommendations, no one -- not even the think tanks themselves -- ever has come up with hard data to justify building more temporary housing for automobiles as a solution to the 'most pressing' needs on Pensacola Beach.

The evil at the core of the plan now endorsed by the News Journal isn't necessarily in the doubling of the bridge toll or the notion of 'improving' the commercial core. It's in the retrograde, unimaginative, fiscally irresponsible and environmentally destructive purpose to which Buck Lee wants to put the added revenue.

The public need for more beach parking is, at best, ephemeral. Even if one accepts that "improvements" and "expanding" of the commercial core are worthy projects, Lee's plan has it exactly backwards. As the most impressive and successful city make-overs demonstrate -- the skywalks of Minneapolis and Des Moines, the light rail systems of Portland and Morgantown, and the walker-friendly shopping and entertainment areas of Seaside and Seattle -- parking ramps shouldn't be at the core of the plan. If at all needed, they should be tolerated as a mere afterthought.

Traffic studies already prove conclusively that the handful of days on Pensacola Beach when parking is a problem are the days when nearby mainlanders come out in unusually high numbers. Those are times, too, when the neighboring towns of Gulf Breeze and Pensacola as well as all of Highway 98 suffer high volume traffic. Solving the so-called beach parking problem really means biting into the broader problem of Pensacola-Gulf Breeze area transportation challenges.

Wouldn't it make more sense if everyone went back to the drawing board and re-thought the whole issue of travel to, from, and around the commercial core of Pensacola Beach, in and through Gulf Breeze, and across the increasingly burdened 3-mile bridge? What better time to consider a futuristic, Twenty-First Century solution than now, as a new national administration comes into office committed to "change" and dedicated to developing within a decade alternatives, like mass transit, to our dependency on foreign oil.

Freshly engaged in late June, Donald Terri danced through a mini-series of elopement ideas finally settling on getting the paper work completed on the Outer Banks two days prior to their celebration party.
The magistrate (long time friend Phil Ruckle) arrived a week early and then on countdown day, 10.09.08 (not selected on purpose but awesomely cool nevertheless), he forgot and had to be rounded up.

Terri's folks, Bud Amy, arrived on schedule the day before. We were still doing a lot of last minute cleaning up. Friend Suzanne was helping out and laughed and said that she felt like she was on one of those redecorating shows when I reported that Bud Amy would be here in thirty minutes.

The weather behaved for a waterfront ceremony on the brand new dock. In attendance were both sets of parents plus wedding and celebration cake baker as well as on the spot photographer, Lewis.

Dinner at Colington Cafe hosted by the Onstads and Portal cake dessert provided by Lewis (which was not actually cut into until Friday evening because we were all pretty tired and full) completed a memorable day.

Tips for beach dating

  • Nov. 10th, 2008 at 3:21 PM

It is said that most of the human communication is done in quietness; the quirk of an eyebrow, a twitch of the lips, a finger on the cheek, and a raised eyebrow -all convey messages that would require several spoken sentences. Therefore, no matter how smooth a talker you may be, no matter how many love tales you have in your repertoire, and no matter how skilled you may be at listening, it’s all for zilch if you ignore body language. You must always keep in mind to note her body language to get the right signal.
1. her palms
A woman will expose her wrists and palms only to people she is attracted to. This is a subconscious display of being docile to you, in which her body is saying If you want me, you can have me.
2. Locked on target
Her shoulder direction is one of the most obvious signs of attraction, so her upper body will most likely be facing you if she is interested. In spirit, she points her shoulders at what she wants.
3. The lean
Leaning forward is also an effortless sign to take. If the girls shoulders point at you and she is leaning towards you, then you can put your mind at ease, its yours for the winning.
4. You coming in or what?
When her legs or feet are wide it means she is very relaxed with her surroundings and with you. Be careful when observing this, if there are other men in the area then it may not be you that makes her easy!
5. Eyes are not just for decoration
Her pupils will get bigger while looking at a person that she likes, and in turn will get smaller while looking at a person she does not. Keep in mind that lights can greatly affect this. For instance, if you are outside when the sun is present her pupils may appear to be very small no matter how much she likes you, and vice versa. The best method to use for testing this is when you can view the change in her pupils when looking at you and then at somebody else.
6. Say
This is a no-brainer. If she smiles at you when you make eye contact, get over there and talk to her without thinking twice about it.
7. When did I become funny?
One of the best signs you can hope for is when she will chuckle at just about every slick thing you try to say. You may begin to think that you might actually be pretty funny but you are wrong, she just likes you a lot and thats better!
8. As good as gold
If she touches you multiple times while she is chatting, like just brushing her arm to yours when trying to make a point, then remember to tell her what you like for breakfast so she knows what to cook the next morning.
9. You must do your duty
She will build an eye contact with a man and hold it for a longer than usual period of time, almost uneasily long. But guys must before they look away, keep in mind to smile at the lady. This will let her know that the guy is interested and is actually a nice guy. Subsequent to this, you may also notice her look at you occasionally.

Where does your label call home? Describe your headquarters.
Our label is run out of a separate space within the same offices as Sub Pop, which is located above the Dahlia restaurant in downtown Seattle. The room we’re in is actually a converted storage space – which I find entertaining – so we had to add the requisite door and window, as well as all of the necessary wiring. It was also painted an unfortunately (read: mind-numbingly) bright orange color until we broke down a couple months ago and painted it something far more reasonable.
Your name? What are your primary duties for the label?
My name is Sarah Moody, and I’m the GM. Though given that there are only two of us when it comes to the day-to-day operations of the label, we just call my cohort Nick Heliotis the General Employee. That’s an easy way of saying we both handle a good smattering of responsibilities for Hardly Art. I handle all of the publicity for the label (except tour press), as well as college radio, and oversee our manufacturing, artwork, and production; I also handle updating the website, and dabble in licensing. Nick handles all of the retail for the label, which includes coordinating releases with our distributor, and keeping track of direct sales and similar departments. He also handles all of the advertising, and is our resident tour publicist extraordinaire.
Who are a few of the bands on your roster? Most recent signee.

This micromanagement of the chancellor hiring process reminds one of the administrative reorganization and IVC presidential hiring process a year ago, the effects of which continue to haunt this district and our community. Trustee Dave Lang in a letter appearing in the Irvine World News, 7/9/98. ~ AN EMBARRASSMENT: It is an embarrassment that this $72 million districtcould attract only nine applicants for the position of chancellor in a nationwide search. The public must pay closer attention to the candidates for election in November to make certain that the public interest and not special interests are represented by the board. Retiring board trustee Joan Hueter, from a statement quoted in the Irvine World News, 7/23/98. ~ THEIR MONKEY BOY: s a lot of on-campus friction. District trustees are morons, the college president is their monkey boy, and the faculty union (which is controlled by Saddlebacks more senior professors) is dirty, vocal IVC teachers say. From a assessment of IVC, appearing in the OC Weekly, 9/4/98. ~ GUN-LOVE IS A MANY SPLENDORED THING: Stop living in an ivory castle. -Trustee Williams, expressing frustration over Trustee Langs expressed doubts about the districts practice of arming its cops. (During the 9/14/98 board meeting.) ~ A SPIN-CONTROLLER SPINNIN OUTA CONTROL: I was told that there were some things I was not to focus on. From my own research, old files and press clippings I got a picture of an administration that was doing some things that I dont think I could represent without violating my own ethicsPeople are walking on eggshells around there. He [Mathur] said he has an open-door policy and that he believes in communication, but I didnt see it. Bevin Zandvliet, who briefly served as Mathurs spinmeister (OC Register, 9/25/98) ~ PIOUS DECEIVERS: [#5 in this year's] Slime-ball campaign tactics. In 1996, the despicable trio of Steven Frogue, Dorothy Fortune and John Williams appealed to anti-gay hysteria to win seats on the SOCCCD Board. This time, Wagner and Padbergwho are backed by the same nasty crowd (a faculty association) that funded Frogue, Fortune, and Williamsare trying to capitalize on another hot-button issue. College trustees have zero say in the fight over a proposed airport at El Toro, but the main theme of Wagner and Padbergs joint, misleading mailer is that they are the only candidates openly fighting the El Toro International Airport. From OC Weeklys election Hall of Shame. (Late October, 98) ~ DYA THINK THEYD TAKE SATANS MONEY? The teachers union? The California Teachers Association is overwhelmingly liberal. I would seriously doubt they would support a conservative Republican like me. I was generally pleased to get the supportbut I think its strange that its the union. Don Wagner, remarking on the support he received from the Faculty Association. In the end, Wagner and Padberg owed their victories to the Association, which spent tens of thousands on their behalf, despite howls of protest from the rank and file. (OC Register, 10/31/98) ~ SHARED WHAT? ...Accreditation teams wrapping up three-day visits to Saddleback and Irvine Valley colleges on Oct. 29 were reportedly by the deep divisions they found between employees and elected officials and warned that the disharmony was eroding service to students. Irvine Valley College, where students organized weekly protests since president Raghu Mathurs 1997 appointment, received the harshest criticism, with the team finding that the district-board-directed obliteration of shared governancein which faculty, staff and community members help administrators and the board shape district policywas a major cause for concern. Saddleback got off easier, but its accreditation team expressed fear that academic programs and student services could suffer unless people just got along. The teams not-so-subtle message to the board: stabilize a district that lost administrators like Burt Reynolds shed hair, and keep your collective nose out of the colleges day-to-day operations. If the colleges want to continue receiving federal aid and having their credits transfer to universities, they must be reaccredited in January 1999. From the OC Weekly, 1/1/99 ~ THOSE NASTY LITTLE FINGERS, EVEN BACK THEN: When you point your finger at someone, three fingers point right back. Raghu P. Mathur, offering his favorite cliche, at the board meeting, 11/16/98. ~ YOURE PUSHIN TOO HARD: I think what Im seeing here is a consistent pattern that we are going to push this as far as we can, said Seymour. And the only thing that seems to work is for the courts to take action. Judge Tully H. Seymour, discussing the 2nd Brown Act lawsuit in court, quoted in the OC Register, 11/21/98. ~ DEFENDING THE : s been writing it for 18 months and only now theyre reprimanding him. Ive been reading it for six or seven months and its always been that way. For me, it was really informative, because I couldnt go to all the board meetings and I relied on The Dissent for what was going on. I find his sense of humor satirical...If anyone knows Roy hes the most soft-spoken and non-violent person you can imagine. Debbie Burbridge, former IVC student (Irvine World News, 1/7/99) ~ GRACIOUS, GREAT, GOIN NOWHERE: m not going anywhere. Raghu Mathur, in his s Welcome Address, January 6, 1999. Raghu also compared himself with Abraham Lincoln. There are, he said, three qualities of greatness: being focused on self-mastery, fixity of purpose, and malice toward none. These, he said, are my goals. ~ PERSISTENT AND DEFIANT MISCONDUCT: A judge has ordered the South Orange County Community College District to tape-record its closed-door meetings for two years because of its persistent and defiant misconduct in violating state open-meeting laws. Orange County Superior Court Judge Tully H. Seymour also referred the case to the District Attorneys Office for possible criminal prosecution, court records show. A prior finding of Brown Act violations against the district in 1997 also will be forwardedThe (district) board engaged in a continuing course of conduct that appears to the court to reflect a total disregard for the requirements of the open-meeting law, Seymour ruled. Terry Franke, director of the California First Amendment Coalition, said Seymours order might set a precedent. This is extraordinary, said Franke, who helped write the Brown Act. This would be the first effective order for taping, and I have absolutely never heard of a judge in a civil (Brown Act) matter taking the initiative to alert the DAs office. From the OC Register, 1/21/99 ~ ET TU, RAGHU? Having tried to work with Raghu for 10 years, first as his dean then as a fellow faculty member, I think his ethics are on a par with Brutus. His word is as good as the now infamous statement ve never had sexual relations with that woman Gary Resnick, retired IVC instructor, in an email sent to faculty in February, 1999. ~ A PRELIMINARY BUTT-KICKING: U.S. District Judge Nora M. Manellas characterization of the Chancellors order that Roy Bauer seek counseling, owing to the newsletters he edited. March 15, 1999. ~ [In Johnson,] the court held that an employer does not have a legitimate interest in covering up mismanagement or corruption and cannot justify retaliation against whistleblowers as a legitimate means of avoiding the disruption that necessarily accompanies such exposure.A review of the recordsuggests that the disharmony at IVC is ongoing and is not solely the product of [Roy B's] speechs speech did not create the on the IVC campus, and silencing him will not eliminate italleges that faculty and other employees are reticent to discourse with [Plaintiff] or speak out at meetings for fear of reprisals, threats or even bodily harm from Plaintiff. This court finds this argument unpersuasive.Plaintiff has been highly critical of the SOCCCD and IVC administrators, but as the Supreme Court noted in Waters, [g]overnment employees are often in the best position to know what ails the agencies for which they work; public debate may gain much from their informal opinions. This court finds defendant has no legitimate interest in silencing plaintiffs speech.. For the reasons set forth above, plaintiffs motion for preliminary injunction is granted. The court finds the six [DISSENT] statements/illustrations at issue in this case constitute protected speech and enjoins defendant from enforcing section 4000.3 and section 4000.5 on the basis of plaintiffs past speech or any similarly protected future speech. The court also enjoins defendant from ordering plaintiff to undergo psychological counseling of any sortIt is so ordered. US District Judge Nora M. Manellas opinion, issued March 19, 1999 ~ CONCILIATORY REMARK: You can take all of Raghu Mathurs critics and stand them up end to end and they wouldnt see his belt buckle. Steven Frogue, quoted in the Irvine World News. Frogue was discussing and promoting his upcoming Reconciliation and Concord breakfast. Not one instructor showed, excepting Ray Whitewash Willy Chandos, Old Guard union crony. (Note to short people: you oughta be pissed off.) ~ SOCCCD: POSTER CHILD FOR A MOVEMENT: Locally elected community college boards would be eliminated and replaced with appointed advisory boards with limited powers under a new proposal released today by the California Citizens Commission on Higher Education.Too often, the commission argues, college boards micromanage their campuses, undermining trained administrators and creating disharmony. Commissioners cite the three years of turmoil at South Orange County Community College District as an example of what could go wrong with locally elected trustees. From the OC Register, 4/6/99 (front page) ~ HYPOCRITE PAR EXCELLENCE: According to district officials, some faculty members taught a full load of classes while chairing a department, and earning over $100,000 a year. In 60 percent of the cases, they had reassigned time and then were teaching classes as overload, said Irvine Valley President Raghu Mathur. From an article in the Irvine World News, 5/27/99, in which IVCs school chair model, abolished during the reorganization, is criticized. Ironically, the here described by district officials describe only Raghu P. Mathur, who, owing to massive amounts of overload and reassigned time, made over $120,00 a year before becoming president. (He was a school chair.) ~ MORE BUTT-KICKAGE: The South Orange County Community College District must pay $98,000 in attorney fees for a faculty member who successfully sued the districts board for violating California open-meeting laws, according to a Superior Court judges order released Thursday. Roy Bauer prevailed in a lawsuit accusing the board of failing to lawfully notify the public about a series of important decisions it made in private. Those decisions involved a reorganization of the two colleges administrations, which removed professors from some key decision-making posts, and the appointment of Irvine Valley College President Raghu Mathur. A judge found that the board had a persistent pattern of violating open-meeting laws, and ordered trustees to tape-record all closed-door meetings. This is Bauers second Brown Act lawsuit victory. From the OC Register, June 18, 1999 ~ PAINFUL CLUTTERECTOMY: On a campus already strained by deep tensions, professors at Irvine Valley College are in an uproar over a new policy that they say threatens the time-honored practice of decorating office doors and windows with the cartoons, clippings and fliers that reflect their humor and passions. Faculty representatives are threatening legal action over a memo teachers received last week telling them to remove any posters or signs they have displayed on their office windows or external doors. The college president, Raghu P. Mathur, says he is seeking only to protect the school from unsightly clutter. But professors allege the policy is a ploy to stifle their ongoing criticism of the schools leadership.Signs on professors doors and windows range from cartoons, newspaper clippings and announcements about grades and scholarships to sharp blows at Mathur. In one window, which faces the campus and can be seen from a distance, large signs proclaim Mathur Must Go and Raghu Must Resign.According to the Irvine Valley College memo, professors have until Sunday to remove their displays or the college will remove them. LA Times, 8/2/99. A truncated version of the story appeared in the LA version of the Times four days later. An OCN report on this issue began airing 8/2/99. A follow-up aired a few days later.
